Death-Penalty Showdown

SAN FRANCISCO - The constitutional brawl over the Antiterrorism and Effective Death Penalty Act of 1996 now kicks into high gear. Last week, the 9th Circuit Court of Appeals took up the question of whether the death penalty infringes on the power of federal judges because it restricts their second-guessing of state courts in criminal habeas review.
