Winning Detainee Hamdan's Case Didn't Prevent Navy Lawyer's Promotion
FORUM COLUMN - By David Frakt - A recent Los Angeles Daily Journal forum article by Erwin Chemerinsky ("Navy Is Wrong to Force Out Guantánamo Lawyer" Oct. 23) suggested that U.S. Navy JAG Lt. Cmdr. Charles Swift was passed over for promotion and was being forced out of the Navy because of his zealous advocacy in the Hamdan case, in which he successfully challenged the military commission system of behalf a detainee at Guantánamo. Hamdan v. Rumsfeld, 126 S.Ct. 2749 (2006).
