Court Must Establish Uniform Standard for Condemnation
Forum Column - By Michael M. Berger - No deity or graffiti artist ever wrote more clearly on a wall. The Michigan Supreme Court plainly telegraphed that it had granted discretionary review of a recent appellate decision in order to reverse a controversial, 23-year-old decision of its own. The decision in Poletown Neighborhood Council v. Detroit, 304 N.W.2d 455 (Mich. 1981), had allowed government agencies to condemn private property for the sole purpose of handing it over to a private business
