Forum Column - By Kelli Sager and Rochelle Wilcox - The California Supreme Court recently reaffirmed the broad protections incorporated into the California Public Records Act for citizens seeking records from government agencies. In a unanimous decision, the court held that a government agency may not avoid its obligation to respond to a request under the act by pre-emptively filing a declaratory relief action seeking a court ruling on whether the agency is obligated to release the requested records. Filarsky v. Superior Court, 28 Cal.4th 419 (2002).
