'Konig' Case Expands Limits of Administrative Agency Authority

Focus Column - By Stuart Miller - On July 29, the California Supreme Court issued an important decision upholding a ruling of the Fair Employment and Housing Commission against constitutional attack. Konig v. Fair Employment and Housing Commission , 28 Cal.4th 743 (2002), appeared to some observers to raise issues that the high court had already addressed, but with a more favorable result for administrative agencies than prior similar cases had produced.
