Preparing Your Witness

Dicta Column - By Kirk A. Pasich - After a jury is selected and the lawyers have presented their opening statements, the typical trial starts with the plaintiff calling its first witness. In most cases, the first witness called is a "friendly" witness, whose testimony will begin laying the foundation for the plaintiff's case. This witness will be the first example that the jury sees of the art of direct examination.
