The 4th District Court of Appeal must consider compassionate release for a terminally ill prisoner in San Diego, the state Supreme Court ruled Thursday.
The decision favoring James A. Loper should "turn the tide" on how lower California appellate courts respond to such petitions, said his lawyer, Raymond M. DiGuiseppe.
