New Bankruptcy Law Requires Scrutiny of Applicability Dates

Focus Column - Bankruptcy Law - By Deborah Chang and Monsi Morales - On April 20, President Bush signed into law the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, which amends various parts of federal bankruptcy law. Within the act, Congress clearly distinguished between the effective date of the amendments and the applicability of such amendments to a bankruptcy case, as determined by the date a case is commenced.
