Due Process Rights Trump Those of Court's Spectators

Focus Column - Criminal Law - By Laurie L. Levenson - Criminal trials are not a spectator sport. As recently noted by the 9th U.S. Circuit Court of Appeals in Musladin v. LaMarque , 2005 DJDAR 4135, spectators' comments and behavior in the courtroom can sometimes deprive a defendant of the right to a fair trial. The only thing that should influence the jury in making its decision is the evidence in the case, not the sentiments of those in the gallery.
