Awkward Language of 'Cumis' Doctrine Creates Confusion

Focus Column - Litigation - By Doug Mastroianni - This year marks the 20th anniversary of the landmark Cumis decision ( San Diego Federal Credit Union v. Cumis Insurance Society , 162 Cal. App. 3d 358 [Ct. App. Cal. 1984, rehearing denied Feb. 21, 1985]). The foundation of the Cumis doctrine is frequently misunderstood.
