Splits Among Federal Circuits Deepen on Procedural Issues

Steinsapir - In June, federal circuit courts created or deepened splits in authority on several procedural issues. Each of the courts in the recent cases adopted holdings that result in enhanced procedural barriers to resolving disputes on the merits.
