Supreme Court Gets Into Split Over Class-Action Arbitrations

Focus Column - Litigation - By Moe Keshavarzi - In 1982, in Keating v. Superior Court , 31 Cal.3d 584 (1982), the California Supreme Court sanctioned the hybrid procedure of class arbitration. Keating , however, left unanswered the question of whether an express ban on classwide arbitration could be unenforceable as an unconscionable agreement under state law.
