Financial Realities of Broken Marriages

Prenuptial agreements that allow a party to waive spousal support for any reason are inherently unfair and should, as a matter of law, be against the public policy of the state of California. Although California courts have long recognized and enforced prenuptial agreements, up until last year they held that provisions waiving spousal support would not be enforceable.
