Nod to Scholar-Advocates Could Be Justice Breyer's Duck Hunt
Forum Column - By Hirbod Rashidi - Much has been written about U.S. Supreme Court Justice Steven Breyer's recent book "Active Liberty," concentrating on the merits of his methodology in adjudicating constitutional cases. Though I tend to agree with those who deem his quest for "active liberty" as nothing more than him trying to get a vibe for what the Constitution stands for, instead of what it actually says (and does not say), I write to raise an ethical question.
