Cross-Examining an Expert Need Not Be Futile Exercise

Column - Trial Strategy - By David B. Baum - Awe and trepidation - these are the emotions typical of the trial lawyer approaching cross-examination of an opposing expert. They are understandable given the expert's specialized background and a practiced demeanor geared to reinforce their authority. Faced with this type of opponent, many advocates subconsciously concede before they begin, approach the expert with no plan and so accomplish little in their cross-examination.
