State Courts Hold No Duty to Stop Nonemployee Harassment

Irizarry - An unfolding drama could find California law becoming more employer-friendly than federal Title VII law on a critical aspect of sexual-harassment compliance. The 4th District Court of Appeal unanimously held in Carter v. California Department of Veterans' Affairs , 2003 DJDAR 6009 (Cal. App. 4th Dist. June 4, 2003), that the Fair Employment and Housing Act "does not impose a duty on an employer to protect an employee from harassment by a nonemployee."
