U.S. District Judge Virginia A. Phillips of Riverside was wrong to sanction a Los Angeles deputy city attorney $63,000 for making an improper argument at trial, a divided 9th U.S. Circuit Court of Appeals panel held Thursday.


Complicating matters, Deputy City Attorney Richard M. Arias admitted fault and apologized - yet Chief Judge Alex Kozinski found the trial record did not support the improper argum...
