Stupidity Doesn't Equal Harassment

Under both Title VII and the Fair Employment and Housing Act, the answer is no. An employer can avoid liability even if an employee acts foolishly. Some inappropriate acts in the workplace, while they may be immodest and may violate common sense, do not violate the FEHA.
