State, Not Federal, Law Governs Security Interests in Copyrights

Genga - Those who provide or obtain financing based at least in part on the borrower's copyrights should take note of a recent 9th U.S. Circuit Court of Appeals decision. In In re World Auxiliary Power Co. , 303 F.3d 1120 (9th Cir. 2002), the court held that state law, not the federal Copyright Act, governs security interests in unregistered copyrights.
