Old Warhorses Like 'Preponderance Of the Evidence' Could Be Obsolete

Loeb - Since September, California courts no longer instruct juries about such courtroom mainstays as "proximate cause" and "the preponderance of the evidence." In response to decades of concern over the complicated language of jury instructions, the Judicial Council recently approved 800 new "plain-language" civil jury instructions.
