Some Cancelled Insurance Policies May Still Be in Force Under 'Mackey'
Focus Column - Insurance Law - By William G. Short - Insurers should take heed, if they have not already, of a little-noticed California decision from earlier this year, Mackey v. Bristol West Insurance Service of California , 105 Cal.App.4th 1247 (2003). Mackey holds that a specific form of cancellation widely used by auto insurers is ineffective. This means that many ostensibly cancelled policies are still in force.
