District Court Ruling Revives Defense of 'Submarine' Patents

SAN FRANCISCO - Last year, the U.S. Court of Appeals for the Federal Circuit gave an unusual gift to some members of the patent-law community. The court, which has exclusive jurisdiction over patent appeals, ruled that an unreasonable delay in prosecuting a patent may prevent its enforcement.
