Death-Row Inmates Gain New Hope From 'Summerlin' Ruling
Focus Column - Constitutional Law - By Stephen F. Rohde - Last year, the U.S. Supreme Court decided that the Sixth Amendment afforded defendants facing the death penalty a constitutional right to have their sentences set by juries, rather than judges. Ring v. Arizona, 536 U.S. 584 (2002). The court left open the issue of whether Ring applied to other death-row inmates who were sentenced by judges and whose appeals are pending in federal court.
