9th Circuit Should Have Considered Remedies Besides Postponement

Forum Column - By Marc Levin - By postponing the recall election in Southwest Voter Registration Education Project v. Shelley , the 9th U.S. Circuit Court of Appeals could force the U.S. Supreme Court to confront its holding in Bush v. Gore. If Shelley is affirmed by the full 9th Circuit, the Supreme Court could reverse Shelley and thereby validate its controversial Bush holding.
