Sexual Stereotypes Can Serve as Evidence of Workplace Bias

Focus Column - Employment Law - By Michelle A. Reinglass - The 9th U.S. Circuit Court of Appeals considered sexual stereotyping as evidence of gender bias in Stegall v. Citadel Broadcasting Co., 2003 DJDAR 13006 (9th Cir. Dec. 2, 2003). Stegall advised trial courts to examine the record for sexual stereotyping that may not appear to be - but, in fact, is - gender-biased.
