Under both federal and state law, it is illegal for an employer to discriminate because of genetic information. To help prevent such discrimination, the Genetic Information Nondiscrimination Act ("GINA") generally forbids employers from obtaining genetic information. But sometimes an employer can find itself in a precarious situation, running afoul of one statute while trying to comply with another.
