'Flutter Faeries' Creative Pitch Results in an Implied Contract

Focus Column - Intellectual Property - By Edward A. Klein - The Court of Appeal recently eased the burden on plaintiffs trying to prove an implied contract in an "idea submission" case. Gunther-Wahl Productions Inc. v. Mattel Inc. , 2002 DJDAR 13785 (Cal. App. Dec. 5, 2002). Although this case is an important decision in this somewhat murky area, it leaves unanswered several important questions.
