Rule 703 Requires Attention to Experts' Underlying Sources

Focus Column - Litigation - By Peter Stern and Becky Kruse - In December 2000, Federal Rule of Evidence 703 was amended to close a "backdoor" exception to the hearsay rule that allowed experts to disclose inadmissible materials to the jury. Two years later, it remains unclear how courts will apply Rule 703. With the "backdoor" now closed, counsel presenting an expert must be prepared with a fist-full of keys to open the way for persuasive testimony.
