California Supreme Court expands fraud exception to parol evidence rule

The state Supreme Court broadened the scope of evidence admissible to prove a contract's validity, overturning a 1935 precedent forbidding application of the parol evidence rule's fraud exception to "promissory fraud"

The state Supreme Court on Monday broadened the scope of evidence that's admissible to prove a contract's validity, overturning a 75-year-old precedent.


The court held that the fraud exception to the parol evidence rule, previously inapplicable to promissory fraud, applied to the plaintiffs' evidence of an alleged oral agreement to extend the term of a loan repayment by two years.
