Supreme Court Punts Mojave Cross Case To Lower Court

The justices said a trial judge should get a second chance to decide whether a First Amendment violation was cured when Congress ordered the site of a cross in the desert be transferred to private ownership.

WASHINGTON - Ruling on a long-running dispute over a cross standing on federal land in the Mojave Desert, the U.S. Supreme Court held on a 5-4 vote Wednesday that a lower court judge should get a second chance to decide whether a First Amendment violation was cured when Congress ordered that the site be transferred to private ownership.
