Orange County DA's blanket papering of judge is unconstitutional, court argues

By violating the separation of powers doctrine, prosecutors broke state law when they issued 55 peremptory challenges on the judge who found misconduct in the jailhouse informant scandal, respondents contend.

Orange County prosecutors violated the state constitution when they directed 55 of 58 murder cases away from a judge "in obvious retaliation" for unfavorable decisions, according to an appellate brief filed Friday by Erwin Chemerinsky and Paul L.
