'Esberg' Should Have Little Effect on Benefits Available for Older Employees

Focus Column - By Niloofar Nejat-Bina - In a broad new opinion, the California Supreme Court has decided that the Fair Employment and Housing Act does not prohibit the denial of benefits to employees older than 40 on the basis of their age. Esberg v. Union Oil Co. of Cal. , 2002 WL 1358622 (Cal. June 24, 2002). The court also concluded that employees cannot bring common-law tort claims that purport to expand the scope of the act.
