Brickner - During voir dire, the judge and the attorneys will necessarily comment on many legal concepts, including but scarcely limited to, burden of proof, pain and suffering damages, circumstantial evidence, presumption of innocence and the right to decline to testify. Invariably and understandably, counsel will feel the need to follow up with a juror on an important point that the lawyer is convinced the juror really doesn't understand.
