9th Circuit panel grants murderer's habeas petition

A divided 9th U.S. Circuit Court of Appeals panel affirmed a lower court's grant of a convicted murderer's habeas petition Thursday because a trial judge wrongly denied the defendant's bid to represent himself.

A divided 9th U.S. Circuit Court of Appeals panel affirmed a lower court's grant of a convicted murderer's habeas petition Thursday because a trial judge wrongly denied the defendant's bid to represent himself.

The panel held that the trial judge's denial of Andre Burton's request on the sole ground that it was a delaying tactic. Burton v. Davis, 2016 DJDAR 2394.
