'Strict Construction' Criterion Doesn't Hold Water
University of Chicago Law School professor Cass R. Sunstein's recent work "Radicals in Robes," published by Basic Books in September, is a welcome effort to classify into four categories judicial approaches to constitutional interpretation. Not that his classifications are necessarily the last word or even accurate or fair (although they are clear and well argued).
