Parts of artist royalty law unconstitutional

The 9th Circuit decided en banc that it could not force art sellers or agents to pay artists 5 percent of the sale price when a work is sold outside California.

A 11-judge federal appellate panel on Tuesday invalidated parts of an often-ignored
state law that requires art owners or their agents to pay a 5 percent royalty to artists
when their works are resold, ruling that the statute can only apply to sales that
occur in California.
