Artists royalty law may get limited OK

An en banc 9th Circuit painted a picture Tuesday of a fine arts resale law that may break the commerce clause but could be at least partially upheld.

A federal appellate court appears poised to dismantle parts of a unique 37-year-old state law that gives artists living all over the world a 5 percent cut on second-hand sales of their work by California residents in a case that could impact everything from the state's environmental regulations to interpreting the rights of artists of all stripes under U.S. copyright law.
