Court Allows Chargebacks From Employee Commissions on Sales

Employment Column - By Jacqueline Cookerly Aguilera and Roxanne Torabian-Bashardoust - In an unanimous opinion that recently was denied review, a California appeal court held that chargebacks from commissions are legally permissible. Steinhebel v. Los Angeles Times Communications , 126 Cal.App.4th 696 (2005), review denied (May 11, 2005). This holding, regarding when a commission becomes a wage, is good news for California employers.
