Insurance Coverage for Elder-Abuse Claims Is Unclear

Focus Column - Tort Law - By Douglas A. Greer - Elder-abuse claims against physicians have become increasingly prevalent. The plaintiffs' bar favors such claims because the "heightened" damages available under the Elder Abuse Act (Welfare and Institutions Code Section 15600 et seq.) can provide an effective way of avoiding restrictions imposed on damages in medical-malpractice actions by the Medical Injury Compensation Reform Act of 1975.
