Companies Cautiously Look to Reissue After 'Festo'

Focus Column - By Amir H. Raubvogel - A reissue application allows a patentee to seek broader claims for a patent that already has been issued as long as the reissue application is filed within two years after the original patent is granted. 35 U.S.C. Section 251. Some patentees have begun to consider using the reissue process to broaden their issued patents in an effort to counteract the effect of recent high-profile court decisions that have narrowed the scope of many existing claims.
