High court punts on highway patrol reponsibility for tow truck crash

The state Supreme Court opined Thursday that the California Highway Patrol is probably not liable for an accident caused by a contracted out tow truck driver but will leave it to a trial court to determine CHP responsibility.

In a reversal Thursday regarding an allegedly reckless tow truck driver, a unanimous state Supreme Court hedged on how liable a state agency is for the private contractors it trains to police the freeways.
