State Supreme Court overturns Arbuckle rule interpretation

The high court was divided 4-3 in the case.

In a 4-3 decision, the state Supreme Court on Thursday voted to reverse an appellate court decision that would broaden the state’s interpretation of “the Arbuckle rule.”

The rule, originally derived from the 1978 case People v. Arbuckle and later broadened to include juvenile cases, requires that judges who accept plea bargains and retain sentencing discretion also be the judge who imposes the sentence.
