'Konig' Case Expands Limits of Administrative Agency Authority
Focus Column - By Stuart Miller - On July 29, the California Supreme Court issued an important decision upholding a ruling of the Fair Employment and Housing Commission against constitutional attack. Konig v. Fair Employment and Housing Commission, 28 Cal.4th 743 (2002), appeared to some observers to raise issues that the high court had already addressed, but with a more favorable result for administrative agencies than prior similar cases had produced.
