Imbalance of Power
Earlier this month, the U.S. Supreme Court issued its ruling in United States v. Oakland Cannabis Buyers Cooperative, the medical marijuana case. By a vote of 8-0 (Justice Stephen Breyer recused himself because his brother was the district judge in the case below), the court reversed the 9th U.S. Circuit Court of Appeals and reached the unsurprising conclusion that properly authorized federal law prevails over state law.
