Class action against Gerber over health claims tossed

A lawsuit against Gerber Products Co. suffered a major blow after a federal judge removed its class status and granted summary judgment to the defendant because the plaintiff failed to prove how she or other consumers were damaged by allegedly misleading food labels.

A customer pursuing a class action against Gerber Products Co. for allegedly lying about the health benefits of a baby formula it sold has had her class decertified, as a federal judge issued summary judgment against the plaintiff for failing to specify how she or other potential class members were injured.
