Judge throws flotation device at lifeguard wage lawsuit

The city of Santa Monica was not amused Friday when a judge cited an obscure state law on amusement workers to keep afloat a class action filed by the city lifeguards.

The city of Santa Monica was not entertained Friday when a judge cited an obscure law about ‘amusement industry’ workers to keep afloat a class action filed by lifeguards.

Calling it a case of first impression, Los Angeles County Superior Court Judge John S. Wiley denied a demurrer filed by Santa Monica in which lifeguards say they swim 1,500 yards a week, fill out paperwork, and do other job tasks while off the clock. Angelos et al....
