Court: Felony murder rule can be based on failure to act
The published decision by the 4th District Court of Appeal affirmed a murder conviction for an Orange County man who committed multiple acts of rape and other sexual assaults on a woman in a diabetic coma. She died two hours after the attack of what coroners determined to be natural causes related to lack of insulin.
