9th Circuit eases activists' secret taping of animals

A split three-judge panel of the court ruled Thursday that portions of the law criminalizing the entry and recording of audio and video footage in agricultural production facilities was overly broad and violated the First Amendment’s free speech protections.

Animal rights activists won a significant victory Thursday when a split three-judge panel of the 9th U.S. Circuit Court of Appeals found that an Idaho law was intended to curb journalists’ unauthorized access to agricultural production facilities and violated the First Amendment.
