In its 12th year, no-fly list litigation proceeds before en banc 9th Circuit in attorney fee stage

Judges on the 9th U.S. Circuit Court of Appeals repeatedly pressed the government Tuesday on its claim that it was justified in defending the suit by a woman placed on a no-fly list although it found out a week after her complaint was filed that she had been placed there in error.

Reviewing en banc an award of attorney fees to a Malaysian woman who fought for years against her placement on the federal no-fly list, judges on the 9th U.S. Circuit Court of Appeals repeatedly pressed the government Tuesday on its claim that it was justified in defending the suit although it found out a week after her complaint was filed that she had been placed on the list in error.
