Adopted child cannot pursue claim of biological parent, circuit says

A panel of the 9th U.S. Circuit Court of Appeals treaded into uncharted waters Tuesday when it considered whether the biological son of a woman who placed him up for adoption could pursue a civil rights lawsuit against police officers who shot and killed her when responding to a 911 call.

A federal appeals panel waded into uncharted water Tuesday when it considered whether the biological son of a woman who placed him up for adoption could pursue a civil rights claim against police officers who shot and killed her.

The court ruled Tuesday the son could not but left open the broader question of whether an individual in a similar situation could proceed with that type of claim if pleaded differently.
